Terms of service

The service

Xarpis provides engineering calculators and generates calculation reports. Calculators are free to use; a paid subscription unlocks clean, unwatermarked PDF reports across the platform.

The service is operated by CLD Consulting, Krøyer Kielbergs Vej 10, 8660 Skanderborg, Denmark ("we", "us", "our").

By using the service you accept these terms. If you use it for an employer or a client, you accept these terms on that organisation's behalf and confirm you are authorised to do so.

Engineering responsibility

Xarpis is a calculation aid. It is not an engineering service, and using it does not create an engineer-client relationship between you and us. We are not the engineer of record for anything you produce.

Responsibility for your use of the software, and for any design, decision, drawing, submission or document that draws on its output, remains with you and your organisation.

That responsibility includes, without limitation: the correctness, units and applicability of every input you enter; your choice of standard, edition, national annex, project factors and load cases; the allowable values, material data and section properties you supply; judging whether the modelled scope fits your case; deciding whether finite-element analysis, physical testing, a lift plan, a proof test or independent review is required; and verifying the output before you rely on it or pass it on.

Each check states its source basis, its assumptions and its scope. Those statements are part of the result and are to be read with it. Checks labelled "awaiting source" or "out of scope" deliberately produce no result and must not be treated as passing.

Reports are not certifications, approvals, stamps, sign-offs, or statements of compliance with any standard, code, regulation or jurisdictional requirement. You must not present Xarpis output as certified, approved, stamped, independently verified or code-compliant.

Nothing in the service reduces or replaces any duty placed on you by law, by your professional body, by your insurer, or by your client.

No warranty

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the service will be uninterrupted or error-free, or that any calculation, formula, source reference, figure or result is correct, complete, current or suitable for your purpose. Software of this kind can contain errors, and every result depends on inputs and engineering judgement that we cannot check.

If you are acting as a consumer, mandatory rights under Danish and EU consumer law are not affected by this section.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, revenue, contracts, goodwill or data, nor for the cost of remedial works, redesign, rework, delay, or third-party claims, however caused and on any theory of liability.

To the maximum extent permitted by law, our total aggregate liability for all claims arising from or connected with the service is limited to the greater of: the amount you paid us for the service in the twelve months before the claim arose, or USD 100.

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Indemnity

You will indemnify us and hold us harmless against claims, losses, liabilities, damages and reasonable costs brought by a third party and arising from your use of the service, from any design or document that relies on its output, or from your breach of these terms.

This does not apply to the extent the claim arises from our own fraud, wilful misconduct or gross negligence.

Your account and acceptable use

Keep your sign-in details secure. You are responsible for activity carried out under your account.

Do not disrupt or attempt to disrupt the service, circumvent access controls, entitlement checks or usage limits, scrape or bulk-extract content, resell or sublicense access, or misrepresent Xarpis output as certified or independently verified when it is not.

Your inputs and reports

You keep all rights in the inputs you enter and the reports you generate. We do not claim ownership of them.

How we handle account, billing and calculation data is set out in the privacy policy.

Our intellectual property

The service, its interface, its documentation, its figures and the software behind it remain ours. Your use of the service grants you a personal, non-exclusive, non-transferable right to use it and to use the reports you generate for your own professional purposes. No other licence is granted.

Xarpis reproduces no copyrighted standard text; source registries hold bibliographic metadata only. Obtaining and holding a licensed copy of any standard you rely on is your responsibility.

Subscription

Xarpis Pro costs $49 per month, or $490 per year, until cancelled. Payment is processed by Stripe. You can pay as a guest, with no password required before purchase.

You can cancel at any time from your account page through the Stripe customer portal. Access continues to the end of the current period. Statutory withdrawal rights under Danish and EU consumer law are unaffected.

Availability and changes to the service

We may change, suspend or withdraw any part of the service. Calculators, their scope, their routes and their source basis may change as sources are verified or standards are revised.

We aim to give notice of material change, but we cannot guarantee the continued availability of any particular calculator, check or route. Reports you have already exported are unaffected.

Changes and governing law

We may update these terms; material changes will be announced on the site or by email. Continued use after a change constitutes acceptance.

If any provision is held unenforceable, the rest remains in force.

These terms are governed by Danish law, with venue in Denmark.
